The Special Criminal Court has heard how an 18-year-old boy took the weapon from the scene of a murder in a restaurant in Blanchardstown last December.

Jaures Kumbu, from Brookhaven Grove, in Blanchardstown, walked out the door with the submachine gun after witnessing someone shooting a man in front of him.

Jason Hennessy Senior (48) died after being shot while having dinner with family and friends at Browne’s Steakhouse in Blanchardstown on Christmas Eve.

The gunman died at the scene and a number of men are due to stand trial for his murder tomorrow.

After the shooting, Jaures Kumbu was identified on CCTV footage putting the gun under his top before leaving the restaurant.

The submachine gun has never been recovered.

At Kumbu’s sentence hearing today, his barrister pleaded for leniency, pointing out that his client didn’t bring the gun to the restaurant.

He said he was completely oblivious to what was about to unfold.

He said he didn’t engage in any violence whatsoever and accepts he made a stupid mistake out of fear for his own life having seen someone being shot in front of him.

He will be sentenced at a later date.
